Legal liability for Forum operators

I think some consideration should be given to discussion forum operators.

Take Whirlpool.net.au and 2Clix for example.

I think forum operators need to have certainty in how to run a forum and still remain within the law.

At present I know there are some operators that have closed forums because they have no certainty regarding their liability. Is it the poster or the operator liable for a users post.

I would be interested in any discussion regarding this issue and to see whether it is really a problem now and what can be done in the future.
